Complaining about a car rental company in Malta: Office for Consumer Affairs (MCCAA)

You rented in Malta and money left your card. The question that drives everything is not the name of the company, it is the country you rented in: that is what decides which authority you can turn to for free. In Malta, the official route is this one, and it costs nothing: Office for Consumer Affairs (MCCAA).

The short answer

What is the free remedy after renting in Malta?

The MCCAA's Office for Consumer Affairs takes complaints free of charge and offers conciliation with the trader. If that fails, the Consumer Claims Tribunal decides small claims, with very low fees and no need for a lawyer. English being an official language, everything happens in a language you can read.

The procedure

Step by step

  1. Written complaint to the rental company, with a fourteen-day deadline.
  2. File your complaint with the MCCAA Office for Consumer Affairs, online.
  3. Accept the conciliation offered: it is quick and many files settle there.
  4. If conciliation fails, take the case to the Consumer Claims Tribunal, whose procedure is designed to be followed without a lawyer.
An accessible tribunal, but a deadline to respectThe Consumer Claims Tribunal is one of the simplest routes in Europe for a small claim, but it has filing deadlines. Do not let it drift: start conciliation as soon as the company's answer is unsatisfactory, and check the applicable deadline at the time you file rather than trusting a figure read on a forum.
The real journey

Where to click, in order

We walked this path ourselves on 2026-08-18. The walls flagged below are the ones we hit, not the ones the law describes.

  1. First write to the rental company setting out the problem clearly and seeking an agreement: the MCCAA requires this before any complaint, and will ask you to prove it.
  2. The page offers two forms: Consumers Complaint Form and ADR Complaint Form. The first goes to the consumer directorate, the second to alternative dispute resolution. For a disputed charge, take the first.
  3. Have proof of purchase, the contract and any commercial guarantee ready: those are the documents the form asks for.
  4. If the conciliation run by the directorate fails, the next step is the Consumer Claims Tribunal. That is the body that can order a refund.

If that is not enough

What comes next, in the same country

  1. Consumer Claims Tribunal, for small claims, no lawyer required.
  2. You do not live in Malta: the European Consumer Centre in your country refers the case to its Maltese counterpart, free of charge.
The other levers

Four more remedies, independent of this one

The country remedy is the second of five. The others do not depend on it and run in parallel: you only need one to succeed.

  1. Written complaint to the rental company, dated facts, exact amount, a 14-day deadline. It is the prerequisite every other procedure demands. Template
  2. European Consumer Centre of your country of residence, free, which refers the case to its counterpart in the company's country. The network covers the European Union, Norway and Iceland. Text
  3. Card payment dispute for services not provided and unauthorised charges, within 60 to 120 days of the charge, the deadline that expires first. Use your bank's secure messaging or complaints form, not a plain email. If the bank refuses, insist on a written and reasoned refusal: it is what opens the free financial ombudsman. Template
  4. Legal expenses insurance, often included in a car or household policy: the insurer appoints a lawyer at its own cost. Email

The fast route

Your letters, already filled in, in ten minutes

The portal writes the complaint to the rental company, the filing with Office for Consumer Affairs (MCCAA), the letter to the European Consumer Centre, the card dispute and the email to your broker, all in your name. It picks the right remedy automatically from the rental country you enter. Free, no commission, no power of attorney: you send them yourself.
