Complaining about a car rental company in Spain: Hoja de reclamaciones and consumer arbitration

You rented in Spain and money left your card. The question that drives everything is not the name of the company, it is the country you rented in: that is what decides which authority you can turn to for free. In Spain, the official route is this one, and it costs nothing: Hoja de reclamaciones and consumer arbitration.

What is the free remedy after renting in Spain?

Every business open to the public in Spain, airport desks included, must keep official hojas de reclamaciones available and hand you one on request. The administrative copy goes to the consumer authority, which moves the file out of customer service. In parallel, consumer arbitration is free and its award binds any trader that has joined the scheme.

The procedure

Step by step

  1. Ask for the hoja de reclamaciones at the desk. Depending on the region it exists in several languages.
  2. Fill it in on the spot, factually: dates, plate, booking reference, amount disputed, and the sentence that matters in your case (no contradictory inspection signed, deposit not released, option imposed).
  3. Keep your copy and file the administrative copy with the municipal consumer office (OMIC) of the branch's town, or with the consumer directorate of the autonomous community.
  4. Already home? The complaint can also be filed in writing, remotely, directly with the autonomous community's consumer body.
  5. Request consumer arbitration in the same letter. Ask for any refusal of arbitration in writing: it documents the trader's bad faith.
If the desk refuses to give you the formRefusing is in principle an administrative offence separate from the dispute itself, sanctioned by the consumer rules of the autonomous community, and it works in your favour. Get it on record: ask for the refusal in writing, or call the local police or Guardia Civil so that it is logged. You then reach the consumer body with two grievances instead of one.

We walked this path ourselves on 2026-08-18. The walls flagged below are the ones we hit, not the ones the law describes.

  1. If you are still in Spain: demand the hoja de reclamaciones at the desk. Every business must hold them, airports included, and refusing to hand one over is a separate offence, worth having recorded on the spot.
  2. Back home: first send your written complaint to the rental company and keep proof of sending. The company has 30 days to answer, and that delay conditions everything that follows.
  3. The Catalan consumer agency's online form goes through « la teva oficina de consum », meaning your municipality of residence in Catalonia. If you do not live there, that door is not open to you: do not waste time on it.
  4. If you live abroad, the effective route is the European Consumer Centre of your own country (eccnet.eu): it exists precisely for cross-border disputes, it is free, and it takes the matter up with its Spanish counterpart for you. That letter is already written below.
  5. Ask for consumer arbitration in the same filing: it is free, and the decision binds any trader signed up to the scheme.

The other levers

Four more remedies, independent of this one

The country remedy is the second of five. The others do not depend on it and run in parallel: you only need one to succeed.

  1. Written complaint to the rental company, dated facts, exact amount, a 14-day deadline. It is the prerequisite every other procedure demands. Template
